The law on product liability in Canada has evolved considerably in recent years and notably in 2011 with regard to government regulations.

In 2011, the federal government introduced the Canada Consumer Product Safety Act which drastically changed the manner in which manufacturers, importers, and sellers of consumer products handle incidents of injury caused by the use of their products. Under the Act, they are required to report such incidents to Health Canada within two days of when they become aware of the incident and a more thorough report within ten days. While the interpretation of what is considered to be an “incident” is somewhat subjective, the Act states that an incident includes “an occurrence in Canada or elsewhere that resulted or may reasonably have been expected to result in an individual’s death or serious adverse effects on their health, including a serious injury.”
